1. User registration

1.1 In order to use some of the benefits of the Site (such as purchasing products), you must register and create an account that is secured with your own password. Your account is personal and exclusive to you and is not transferable to any third party.

1.2 To be a Registered User, you must be 21 years old and provide true and accurate information (including your name, date of birth, email address, etc.) as required during the account creation process.

1.3 You are responsible for maintaining the confidentiality of your account. If you have concerns about your account or become aware of misuse, please report it to us immediately (see the Contact Us page for more information and details).

 

2. Purchase order

2.1 You must pay the full amount as stated during the ordering process, including shipping costs or other fees that you may be incurred.

2.2 Once the order is “confirmed”, we will send you an order confirmation email.

2.3 Following our acceptance of your order, we will dispatch the products ordered if you have paid the full amount through your card (or if payment has been agreed upon at the time of delivery of the products).

2.4 You can review the details of your previous orders through the “Your Account” page on the website

 

3. Payment

3.1 We accept credit card payment for your order, after we verify your card details. We also accept cash on delivery of products (refer to Section 4).

3.2 In the event that the Products are not available, we will inform you as soon as possible and a full refund will be given (to the same account used to pay for the purchase).

3.3 To ensure that your Card is used with your consent, whether you choose K-net or Visa/MasterCard as a payment method, we will direct you to the relevant payment gateway where you will be asked to enter your card details (such as card number, expiration date and pin code).

3.4 The responsibility for verifying the customer and the customer's card information (to authorize the payment transaction) is the responsibility of the respective payment gateway or card issuer bank. We are not responsible for any losses or damages that occur from fraudulent transactions that may occur due to cyber attacks or breaches on any payment gateway or on issuing banks, or due to customer card details, PIN verification details, password verification details or any other details which allow purchases through a payment gateway to be obtained by persons with malicious intent or persons who may not be the legitimate owners of the card.

3.5 Prices include taxes (if applicable) but do not include delivery charges (unless otherwise noted).

3.6 We make every effort to ensure that the prices of products displayed on listroma.com are included accurately, however errors may occur. If we discover an error in the price of products you have ordered and paid for, we will inform you as soon as possible and give you the option to either reconfirm your order at the correct price or cancel the order. If we are unable to contact you, we will automatically treat the order as canceled and refund you if you have already paid. If you wish to cancel an order that you have already paid for, we will issue a full refund.

 

4. Cash on Delivery

We accept cash or card payment upon delivery of products according to the following conditions:

4.1 You can pay with a credit card from the mobile payment device available at the company representative

4.2 We do not accept payment by check, gift voucher or discount voucher in lieu of cash or card.

4.3 If we are unable to contact the customer within 48 hours of the specified delivery date, the order will be automatically canceled.

 

5. Discount Coupons

We may issue discount coupons and a promotional code (and other marketing incentives) to registered users that may be availed, subject to the following;

5.1 Discount coupons are valid until the stated expiry date.

5.2 The use of discount coupons must be activated prior to payment.

5.3 The discount voucher cannot be used in part, nor can it be used twice.

5.4 The discount coupon cannot be used in case of cash on delivery as a method of payment.

5.5 Users can only use one discount coupon per purchase order transaction.

 

6. Terms and Conditions of Warranty

All products are covered by a (xxx) year warranty for manufacturing defects. Warranty does not cover repairs resulting from misuse, breakage, or use of unsuitable cleaning chemicals

 

7. Miscellaneous provisions

7.1 Your use of the Website and your purchase contracts for Products with List Roma are subject to the laws of the State of Kuwait.

7.2 Any links to other Internet sites on listroma.com are for the convenience and service of the user, and we are not responsible for the content or operation of those sites. Use of these websites is at your own risk and cost.

7.3 We reserve the right to transfer, assign or contract the benefit of part or all of any of the rights or obligations to any third party.

7.4 No delay or failure to exercise any powers or rights on our part under these Terms shall be deemed a waiver thereof.

7.5 The user agrees that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement and are equivalent to legal written communication

 

8. Liability and compensation

8.1 WE DO NOT WARRANT THAT THE SITE OR ANY OF THE SERVICES AVAILABLE THROUGH THE SITE WILL BE ERROR-FREE, AND THERE MAY BE DELAYS, INACCURACIES OR OMISSIONS IN THE MATERIALS OR SERVICES AVAILABLE THROUGH THE SITE.

8.2 We take all reasonable measures to prevent viruses and such harmful code to listroma.com, however, we cannot guarantee that the Website (and the Service available through it) are free of such harmful features. We are not responsible for any damages or malfunctions that may result or arise directly or indirectly from the website services.

8.3 In no event will we be liable to you (or any third party) for any direct or indirect consequential loss or damage (such as loss of profits, software or data).

8.4 It is your responsibility to maintain the confidentiality of your account and password and to restrict the use of your computer. We are not responsible for losses resulting from unauthorized access to the information you have provided.

8.5 We reserve the right to refuse service, suspend or terminate accounts, cancel orders, and remove content in our sole discretion.

8.6 We will not be liable for delay or failure to deliver Products or performance of any obligation due to events of force majeure and events beyond our control (noting that force majeure means, without limitation, events of war, civil war, disorder, insurrection, riot, floods, earthquakes, hurricanes, or any other natural disaster).

 

9. Intellectual Property

9.1 You acknowledge and agree that all trademarks, copyrights and all other intellectual property rights (in materials and/or content) made available to your use of listroma.com remain owned by us at all times.

All trade names, service names, product names or logos are trademarks owned by us and are protected by the laws of the State of Kuwait.

The materials on listroma.com are available for personal, non-commercial use.

 9.2 As a Registered User, you may wish to post reviews, questions or suggestions. You agree not to post any content that violates public morals, contrary to applicable laws and public morals, or inflammatory topics

9.3 We have the right and the option (but not the obligation) to monitor or remove any User Content, and have no responsibility for any Content posted by you or any third party.
